1. Introduction

This Privacy Policy describes how Petslify, operated by Diamonds Painting Inc ("we," "us," or "our"), collects, uses, and discloses your Personal Information when you visit or make a purchase from petslify.com (the "Site").

By using the Site, you agree to the collection and use of information in accordance with this Privacy Policy and our Terms of Service.

3. Collecting Personal Information

When you visit the Site, we collect certain information about your device, your interaction with the Site, and information necessary to process your purchases. We may also collect additional information if you contact us for customer support. In this Privacy Policy, we refer to any information about an identifiable individual as "Personal Information." See the list below for more information about what Personal Information we collect and why.

  • Device Information
    • Purpose of Collection: To load the Site accurately for you, and to perform analytics on Site usage to optimize our Site.
    • Source of Collection: Collected automatically when you access our Site using cookies, log files, web beacons, tags, or pixels.
    • Disclosure for a Business Purpose: Shared with our processor Shopify and analytics providers.
    • Personal Information Collected: Version of web browser, IP address, time zone, cookie information, what sites or products you view, search terms, and how you interact with the Site.
  • Order Information
    • Purpose of Collection: To provide products or services to you to fulfill our contract, process your payment information, arrange for shipping, provide you with invoices and/or order confirmations, communicate with you, screen our orders for potential risk or fraud, and provide you with information or advertising relating to our products or services.
    • Source of Collection: Collected from you.
    • Personal Information Collected: Name, billing address, shipping address, payment information (including credit card numbers, processed securely by our payment processors), email address, and phone number.
  • Pet Photo Information
    • Purpose of Collection: To fulfill your custom plush order and, with your permission, to use photos in our marketing and promotional materials. See Section 19 for full details.
    • Source of Collection: Submitted by you during the order customization process.
    • Personal Information Collected: Photos of your pet submitted via our customizer or by email. These photos may incidentally include images of people or locations.
    • Your Rights: You may opt out of marketing use of your photos at any time by emailing support@petslify.com. Photo use for order fulfillment is still required to complete your order.
  • Customer Support Information
    • Purpose of Collection: To provide customer support.
    • Source of Collection: Collected from you.
    • Personal Information Collected: Any additional information you choose to provide during interactions with our customer support team.
  • SMS / Text Marketing Information
    • Purpose of Collection: To send you order updates, abandoned cart reminders, promotional messages, and review requests via text message, if you have opted in.
    • Source of Collection: Collected from you at checkout or via our subscription tools when you provide your phone number and consent.
    • Personal Information Collected: Mobile phone number and SMS opt-in consent status.
    • Disclosure: SMS opt-in data and consent are not shared with any third parties except messaging platform partners, solely for the purpose of enabling and operating our text messaging program.

4. Minors

The Site is not intended for individuals under the age of 13. We do not intentionally collect Personal Information from children under 13. If you are the parent or guardian and believe your child has provided us with Personal Information, please contact us at the address in Section 2 to request deletion. We will take prompt steps to delete such information.

5. Sharing Personal Information

We share your Personal Information with service providers to help us provide our services and fulfill our contracts with you, as described above. For example:

  • We use Shopify to power our online store. You can read more about how Shopify uses your Personal Information here: https://www.shopify.com/legal/privacy.
  • We use payment processors (such as Stripe, PayPal, Shop Pay) to securely handle payment transactions. We do not store full credit card numbers.
  • We use Loox, a customer review platform, to collect and display verified customer reviews on our Site. When you leave a review, Loox may collect your name, email address, photos, and review content. Loox may also send you follow-up review request emails on our behalf after your order is delivered.   • We use Zipify Pages, a Shopify page builder, to create and display certain pages on our Site. Zipify may collect approximate location data (country-level) through a geolocation service to display the correct currency and regional pricing.
  • We use SMS messaging platform partners to operate our text marketing program. SMS opt-in data and consent are shared with these partners solely to enable the messaging service and are not used for any other purpose or shared with any other third parties.
  • We may share your Personal Information to comply with applicable laws and regulations, respond to a subpoena, search warrant, or other lawful request for information we receive, or to otherwise protect our rights.
  • If we merge with, are acquired by, or transfer assets to another company, your Personal Information may be transferred as part of that transaction. We will notify you via the email address associated with your account or a prominent notice on our Site before your Personal Information becomes subject to a different privacy policy.

6. Behavioral Advertising

As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. For example:

  • We may use TikTok Pixel to measure ad performance and serve targeted ads on TikTok. You can manage your ad preferences at: TikTok Privacy Settings.
  • We use Hotjar to understand how visitors interact with our Site through heatmaps, session recordings, and feedback tools. Hotjar collects anonymized usage data including mouse movements, clicks, and scroll behavior. Hotjar does not collect personally identifiable information by default.   • We use Microsoft Clarity to analyze user behavior on our Site through session replay and heatmap analytics. Clarity captures anonymized interaction data including clicks, scrolls, and page navigation patterns.   • We use Shopify Audiences to help us show ads on other websites with our advertising partners to buyers who may be interested in our offerings.
  • We share information about your use of the Site, your purchases, and your interaction with our ads on other websites with our advertising partners. This information may be collected through cookies or other similar technologies.

7. Using Personal Information

We use your Personal Information to provide our services to you, which includes:

  • Offering products for sale and processing orders.
  • Processing payments securely through our payment processors.
  • Shipping and fulfillment of your order.
  • Communicating with you about your order status, updates, and customer support.
  • Keeping you up to date on new products, services, and offers (where you have consented).
  • Sending SMS/text marketing messages and order notifications (where you have opted in).
  • Using pet photos you submit for order production and, with your consent, for marketing purposes (see Section 19).
  • Screening orders for fraud and complying with legal obligations.

8. Lawful Basis under GDPR

Pursuant to the General Data Protection Regulation ("GDPR"), if you are a resident of the European Economic Area ("EEA") or United Kingdom, we process your Personal Information under the following lawful bases:

  • Consent — where you have given us clear consent (e.g., for marketing emails or SMS, or for use of your photos in marketing).
  • Contract performance — where processing is necessary to fulfill the contract between you and us (e.g., processing your order).
  • Legal obligation — where we must process your data to comply with applicable law.
  • Legitimate interests — where we have a legitimate business interest that does not override your fundamental rights and freedoms (e.g., fraud prevention, improving our Site).

You have the right to withdraw consent at any time where consent is the lawful basis for processing. Withdrawal does not affect the lawfulness of processing carried out before withdrawal.

9. Retention

When you place an order through the Site, we will retain your Personal Information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, including for legal, accounting, or reporting requirements. Typically, we retain order-related information for a minimum of 7 years to comply with applicable tax and commercial laws.

If you ask us to delete your information, we will do so subject to any legal obligations to retain certain records. For more information on your right of erasure, please see the Your Rights section below.

10. Automatic Decision-Making

If you are a resident of the EEA, you have the right to object to processing based solely on automated decision-making (including profiling) when that decision-making has a legal effect on you or otherwise significantly affects you.

We DO NOT engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.

Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you. Services that include elements of automated decision-making include:

  • Temporary blacklist of IP addresses associated with repeated failed transactions. This blacklist persists for a small number of hours.
  • Temporary blacklist of credit cards associated with blacklisted IP addresses. This blacklist persists for a small number of days.

11. Selling or Sharing Personal Information

Our Site does not sell Personal Information for monetary consideration, as defined by the California Consumer Privacy Act of 2018 ("CCPA") and the California Privacy Rights Act of 2020 ("CPRA").

However, we may share Personal Information with advertising partners for cross-context behavioral advertising (as defined under CPRA), including through the use of cookies, pixels, and similar tracking technologies described in Section 6 above. California residents have the right to opt out of this sharing. See Section 12 and the "Do Not Sell or Share My Personal Data" section below for how to exercise this right.

12. Your Rights

12.1 GDPR (EEA and UK Residents)

If you are a resident of the EEA or United Kingdom, you have the right to:

  • Access the Personal Information we hold about you.
  • Port your Personal Information to a new service.
  • Request correction or updating of inaccurate Personal Information.
  • Request erasure of your Personal Information (subject to legal retention obligations).
  • Object to processing of your Personal Information where we rely on legitimate interests.
  • Withdraw consent at any time where consent is the lawful basis.

Your Personal Information will be initially processed in Ireland and then transferred outside of Europe for storage and further processing, including to Canada and the United States. 12.2 CCPA / CPRA (California Residents)

If you are a resident of California, you have the following rights under the CCPA and CPRA:

  • Right to Know: The right to know what Personal Information we collect, use, disclose, and share about you.
  • Right to Delete: The right to request deletion of your Personal Information, subject to certain exceptions.
  • Right to Correct: The right to request correction of inaccurate Personal Information we hold about you.
  • Right to Opt Out of Sale or Sharing: The right to opt out of the sale or sharing of your Personal Information for cross-context behavioral advertising. See the Do Not Sell or Share section below.
  • Right to Limit Use of Sensitive Personal Information: The right to limit our use of sensitive Personal Information to what is necessary to provide the services you requested.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA/CPRA rights.

To exercise your rights, please contact us using the details in Section 2. We will verify your identity before processing your request. You may also designate an authorized agent to submit requests on your behalf.

12.3 Do Not Sell or Share My Personal Data

We do not sell your Personal Information for money. However, as described in Section 6, we share certain browsing and interaction data with advertising partners (Google, Meta, TikTok, Hotjar, Microsoft Clarity, Shopify Audiences) for targeted advertising and analytics purposes. Under the CPRA, this may constitute "sharing" of Personal Information for cross-context behavioral advertising.

To opt out of this sharing:

  • Use the opt-out links for each platform listed in Section 6 above.
  • Enable the Global Privacy Control (GPC) signal in your browser, which we will honor for California residents.
  • Contact us directly at support@petslify.com to request that we stop sharing your data with advertising partners.

Please note that opting out of data sharing for advertising may affect your experience of seeing relevant ads from Petslify on other platforms.

14. Do Not Track

Please note that because there is no consistent industry understanding of how to respond to "Do Not Track" signals, we do not alter our data collection and usage practices when we detect such a "Do Not Track" signal from your browser.

However, we do honor the Global Privacy Control (GPC) signal for California residents as a valid opt-out of sharing of Personal Information for cross-context behavioral advertising, consistent with CPRA requirements.

15. Changes

We may update this Privacy Policy from time to time to reflect changes to our practices, for legal or regulatory reasons, or for other operational reasons. When we make material changes, we will update the "Last updated" date at the top of this policy and, where required by law, notify you by email or by a prominent notice on our Site. We encourage you to review this Privacy Policy periodically.

17. Text Marketing and Notifications (SMS)

By consenting to Petslify's SMS marketing at checkout or subscribing via our subscription tools, you agree to receive recurring automated text notifications at the phone number provided, including:

  • Order updates and shipping notifications
  • Abandoned cart reminders
  • Promotional marketing messages and special offers
  • Requests for reviews of your order

You may receive these messages even if your mobile number is registered on any state or federal do-not-call list.

Important disclosures:

  • Consent is not a condition of purchase. You are not required to opt in to SMS to buy from us.
  • Message frequency varies depending on your activity and our promotional calendar.
  • To unsubscribe: Reply STOP to any text message from us. You will receive one confirmation message and then no further messages. You may re-subscribe at any time by texting START or by opting in again at checkout.
  • For help: Reply HELP to any text message or contact us at support@petslify.com.
  • Message and data rates may apply. Standard carrier rates apply to all messages sent and received. We do not charge you for the SMS service itself.
  • Carrier liability: Carriers are not liable for delayed or undelivered messages.
  • No third-party sharing: Your SMS opt-in data and consent will not be shared with any third party except our messaging platform partners, solely to operate the text messaging service. It will not be used for any other purpose or sold.

Our website uses cookies to keep track of items you put into your shopping cart, including when you have abandoned your checkout. This information may be used to determine when to send cart reminder messages via SMS, where you have opted in.

18. Age of Consent

The Site is not intended for individuals under the age of 13. We do not knowingly collect Personal Information from children under 13. If you are a parent or guardian and believe your child has provided us with Personal Information, please contact us immediately at support@petslify.com and we will promptly delete such information from our records.

19. Customer Photo Use and Marketing License

When you upload or submit photos of your pet or other images through our customizer or by email for the purpose of creating a custom plush, you grant Petslify a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such photos in any media for marketing, promotional, and other commercial purposes.

This means we may use your pet photos in:

  • Our website, social media accounts, and online advertisements
  • Email marketing and promotional campaigns
  • Third-party advertising platforms (Google, Meta/Facebook, TikTok, etc.)
  • Press and media materials

Your opt-out right: If you do not want your photos used for marketing purposes, you may opt out at any time by emailing support@petslify.com with your name and order number. We will remove your photos from active marketing use. Please note that this will not affect photos already published and cannot retroactively remove photos that have been shared. Photo use for the purpose of fulfilling your order is still required and not subject to the opt-out.

You represent and warrant that you own or have the right to grant these permissions for all photos you submit, and that submission of the photos does not violate the rights of any third party.
