1. Introduction

Welcome to Petslify! This website is operated by Petslify, a company registered under Diamonds Painting Inc. Throughout the site, the terms "we," "us," and "our" refer to Petslify. We offer this website, including all information, tools, and services available from this site to you, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

The headings used in these Terms are included for convenience only and will not limit or otherwise affect these Terms.

2. Acceptance of Terms

By accessing or using our website at https://petslify.com/ (the "Site") and purchasing products from us, you engage in our "Service" and agree to be bound by these Terms of Service ("Terms"), including any additional terms and conditions and policies referenced herein or available by hyperlink, including our Privacy Policy. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

These Terms apply to all users of the Site, including without limitation users who are browsers, vendors, customers, merchants, and contributors of content.

3. Changes to the Terms

We reserve the right to update, change, or replace any part of these Terms by posting updates and changes on our website. The date of the most recent revision will appear at the top of this page. It is your responsibility to check this page periodically for changes. Your continued use of or access to the Site following the posting of any changes constitutes acceptance of those changes. For material changes, we will endeavor to provide reasonable notice, such as a notice on the Site or an email to the address associated with your account.

4. Eligibility

By agreeing to these Terms, you represent that you are at least the age of majority in your state, province, or country of residence, or at least 13 years old if the age of majority is younger, and that you have given us your consent to allow any of your minor dependents to use this Site under your supervision. You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction.

5. Use of the Site and Services

We grant you a limited, non-exclusive, non-transferable, and revocable license to use our Site and Services for personal, non-commercial use. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission by us. Unauthorized use of the Site may give rise to a claim for damages and/or be a criminal offense.

6. Orders and Payment

6.1 Order Acceptance

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. In the event we make a change to or cancel an order, we will attempt to notify you by contacting the email address provided at the time the order was made.

6.2 Cancellation Overview

Order cancellations are available at any time before your order has shipped, as described in Section 8.2. If you request a cancellation before shipment, you will receive a full refund, and we do not charge a design fee. Once an order has shipped, it cannot be canceled (Section 8.2.2).

6.3 Payment Terms

All prices are listed in U.S. dollars (USD) as our base currency. Where the Site displays prices in another currency (for example, AED for visitors in the United Arab Emirates), such prices are converted from USD using a current exchange rate and are for reference only. All transactions are processed and charged in USD at the exchange rate applied at the time of checkout. By placing an order, you authorize us to charge the designated payment method in USD for the amount shown at checkout.

You agree to provide current, complete, and accurate purchase and account information for all purchases. We accept various payment methods including credit cards, Shop Pay, PayPal, and other options displayed at checkout. We reserve the right to refuse any payment method at our discretion.

6.4 Shipping, Delivery, and Address Accuracy

Shipping and delivery timelines are estimates and are not guarantees. Delays may occur due to carrier issues, customs processing, weather, peak seasons, or events outside our control.

For orders shipped outside the United States, local authorities may assess import duties, VAT/GST, taxes, or brokerage/handling fees upon import or delivery. We do not collect these charges at checkout and are not responsible for them. You are responsible for paying any such charges required by your country.

You are responsible for providing a complete and correct shipping address at checkout. If a package is returned to us due to an incomplete or incorrect address, refusal of delivery, or failure to claim the package, we can reship it at your expense or process a refund only after the item is returned to our returns center (see Section 8).

6.5 Promotional Pricing and Discount Codes

Comparative and Reference Pricing. Where we display a "price elsewhere," "compare at" price, or similar reference price for a competitor's product, such price is based on the publicly listed price of a comparable product offered by an identified competitor, verified at the time the comparison was established. Size, features, and specifications may vary between products. We document the basis for all comparative price claims and update them when we become aware of changes. Comparative price claims are not based on our own former prices unless explicitly stated.

Discount Codes and Promotional Offers. Discount codes and promotional offers are subject to the following conditions unless otherwise stated at the time of the promotion:

  • Codes are single-use, non-transferable, and non-combinable with other offers unless explicitly stated.
  • Codes may have an expiration date. Expired codes will not be honored at checkout. Displaying or sharing an expired code does not create an obligation for us to honor it.
  • We reserve the right to modify or terminate any promotional offer at any time. Promotions that have a stated end date will not be extended unless announced publicly.
  • A discount code applied to an order does not affect the base price of the product for purposes of any refund or return calculation. Refunds will be issued for the amount actually paid after the discount was applied.
  • Codes cannot be applied retroactively to orders already placed.

6.6 Limited-Time Offers and Bundles

From time to time, we offer bundle promotions ("Bundle Offers") that include additional products or services alongside a primary order (for example, a Boutique Crate Box, Digital Portrait, or Sneak Peek service included at no additional charge for a limited period).

  • Limited-time duration: Bundle Offers are available for the period displayed on the Site (including via countdown timer). Once a Bundle Offer expires, bundle components revert to their standard pricing.
  • Bundle perk definitions:
    • "Digital Portrait" means a digital illustration of your pet rendered from the photos you provide, delivered electronically.
    • "Boutique Crate Box" means a branded packaging box.
    • "Plush Revisions" means the revision service described in Section 8.5.
  • Returns and bundle perks: If you return a plush and receive a refund under Section 8.1, you are entitled to a refund of the amount paid for the plush. Bundle perks included at no additional charge (e.g., a free Digital Portrait or Crate Box delivered as part of a Bundle Offer) are not separately refundable. If you paid separately for a bundle component (e.g., a paid Sneak Peek), its refundability is governed by Section 8.5.
  • Bundle items added at fulfillment: Certain bundle components (for example, a plush comb or similar item) may not appear as a separate line item in your cart or order confirmation at checkout. This does not mean the item has been omitted. All orders placed during an active Bundle Offer are tagged in our system, and any items included in that bundle will be physically added to your shipment at our fulfillment warehouse before your package is dispatched. You do not need to take any action — if you placed your order during a bundle promotion period, the included bundle items will be in your package.
  • We are not responsible for technical issues preventing you from accessing a digital product (such as the Digital Portrait) if you provided an incorrect email address or if delivery was attempted and rejected by your email provider.

7. Product Description and Custom Orders

7.1 Product Origin

All our custom plush products are produced in our facilities in China. Order handling, quality control, and shipment processing are managed from our logistics and fulfillment warehouse located in Florida, USA. No manufacturing or production processes are performed at our U.S. warehouse locations. We do not make any "Made in USA" or "American-made" claims with respect to our plush products.

7.2 Custom Orders and Reference Materials

By submitting photographs or images to us for custom products, you represent and warrant that you own the rights to the content or have obtained permission from the rights holder. You grant us a license to use such photos for order fulfillment purposes. In addition, your submission of photos is also subject to the broader marketing and promotional license described in Section 9.1, which governs all rights to customer photos. In the event of any conflict between this Section 7.2 and Section 9.1, Section 9.1 shall govern.

7.3 Handmade Nature and Color/Texture Variation

We strive to display as accurately as possible the colors and images of our products. However, we cannot guarantee that your device's display of any color will be accurate. Because each plush is handmade and customized based on the photos you provide, the final product is a crafted interpretation of your pet. Minor differences in stitching, texture, shading, and small details are normal and are not considered defects. This does not limit your return rights under Section 8.

Requesting, receiving, or accepting photos or modifications through the Sneak Peek (Plush Preview Service) does not constitute acceptance of the final product and does not void, reduce, or waive your post-delivery return rights under Section 8.1.

7.4 Plush Backpacks Shipping

We reserve the right to fulfill orders for Plush Backpacks from any location we choose, including a U.S.-based warehouse or our China-based warehouse. Shipping times may vary depending on the warehouse from which the product is shipped.

7.5 Warehousing, Handling, and Shipping

Petslify operates logistics and fulfillment warehouses located in Florida, USA. These warehouses are used for handling, quality control inspections, packaging, and shipment processing of customer orders and non-custom items. All manufacturing and product assembly activities occur overseas. No manufacturing or production processes are performed at our U.S. warehouse locations.

8. Returns and Refunds

This Section 8 is intended to provide clear disclosures and align with applicable U.S. consumer protection requirements, including the Federal Trade Commission's Mail, Internet, or Telephone Order Merchandise Rule (16 C.F.R. Part 435). Nothing in these Terms limits any rights that cannot be waived under applicable law.

Summary

  • Cancel before shipment: eligible for a full refund (Section 8.2).
  • After delivery: return within 30 days of delivery for a full refund

8.0 Definitions

  • "Order placement time" means the timestamp shown in your order confirmation and/or your Shopify order record.
  • "Production phase" or "production stage" means the period following order placement time during which custom work and materials allocation may begin.
  • "Boutique Crate Box" means an outer shipping box used for packaging and delivery of your order (it is not a pet crate). Depending on the offer presented at checkout, the Crate Box may be included at no charge or sold as a paid add-on.
  • "Shipped" means the order has been handed to the carrier and/or has received a carrier acceptance scan. Creating a shipping label alone does not constitute shipment.
  • "Before shipment" means before the order is Shipped as defined above.
  • "Sneak Peek (Plush Preview Service)" means an optional paid service providing preview photos of the finished plush for customer feedback before shipment.
  • "Preview Photos" means any design or preview images we send during the creation process to request feedback, whether provided through Sneak Peek (paid) or as a courtesy (free).
  • "Revision" means a reasonable set of requested changes based on feedback to Preview Photos. A Revision does not include a complete redesign, a change to a different pet, or changes not supported by the photos or instructions provided.

8.1 Returns After Delivery (30 Days)

If you are not satisfied after delivery, you can request a return within 30 days of the date of delivery. To qualify for a refund, your return must meet all of the following conditions:
- Requested within 30 days of delivery
- All original accessories and items included

We will provide you with a prepaid return shipping label to make the return process as easy as possible. To receive your return shipping label, please contact our customer service team at support@petslify.com 

Time is of the essence for return requests. Return requests received after 30 days from delivery will not be honored, except where required by applicable mandatory consumer protection law.

8.1.1 Return Address

Send returns only after receiving the return shipping label from our customer service team. The return address will be pre-filled on the prepaid return shipping label we provide:

Do not send returns to any other address. Returns sent to unauthorized addresses may not be received, processed, or refunded.

8.2 Order Cancellation Policy

We allow order cancellations at any time before your order has Shipped. Upon a valid cancellation request received before shipment, we will provide a full refund. We do not charge any design fee for canceled orders.

8.2.1 Cancellation Before Shipment

If you request to cancel your order before it has Shipped, you will receive a full refund of the amount paid. No design fee or other penalties apply for cancellations prior to shipment. This applies regardless of whether you purchased Sneak Peek (Plush Preview Service) and regardless of whether Preview Photos were sent or received.

8.2.2 No Cancellations After Shipment

Once an order has Shipped, it cannot be canceled. If you wish to request a refund after delivery, you must follow the return process in Sections 8.1 and 8.3.

8.2.3 Shipping Delays and Notices (Orders Not Yet Shipped)

If an order has not Shipped and we become aware of a material delay beyond the estimated production timeframe, we will notify you and request consent to an updated shipment timeframe. If you do not consent, we will process the cancellation and refund in accordance with this Section 8 and any applicable legal requirements (including, where applicable, 16 C.F.R. Part 435).

8.3 How to Initiate a Return/Refund (After Delivery)

Contact our customer service team at support@petslify.com for return instructions and a prepaid shipping label before sending anything back.

Refunds are processed after the returned item is received at our returns center, inspected, and confirmed to meet the eligibility criteria. We will process the refund to the original payment method within 5 to 21 business days after inspection. Processing times may vary depending on your bank or card issuer.

8.3.1 Refused Delivery, Return-to-Sender, or Undeliverable Packages

If a package is refused, returned to sender, or undeliverable due to address issues or failure to claim the package, any refund (if applicable) will be processed only after the item is received back at our returns center and inspected. We may deduct reasonable shipping, handling, or carrier return fees from the refund where permitted by law.

If your order arrives visibly damaged, or if your tracking information shows Delivered but you are unable to locate the package, please contact us at support@petslify.com within 7 days of the delivery date shown on tracking. Include your order number and photos of any damage. Failure to report a damaged or missing shipment within this window may affect our ability to resolve the issue with the carrier. For orders whose tracking shows no delivery update and which appear stalled in transit, please contact us within 30 days of the shipment date shown on your tracking confirmation.

8.4 Preview Photos and Feedback Window

Where Preview Photos are provided, we invite feedback before finalizing and shipping. Any reply to the preview email counts as a response, including requests such as "please resend as attachments" or "I approve."

If we do not receive a response within 3 days, we may proceed to finalization and shipment to avoid delays. Please check your spam/junk folder and ensure your email address is correct. Proceeding due to non-response does not limit your return rights under Section 8.1 and does not change the cancellation rule for requests made before shipment under Section 8.2.1.

8.5 Sneak Peek (Plush Preview Service) and Revision Policy

Sneak Peek (Plush Preview Service) is an optional paid service providing Preview Photos of the finished plush for customer feedback before shipment. If Sneak Peek was not purchased, we may still provide Preview Photos as a courtesy. Courtesy Preview Photos do not change any cancellation or return conditions in Section 8.

8.5.1 Revision Limit

Whether Sneak Peek was purchased or Preview Photos were provided as a courtesy, we may offer up to two (2) Revisions based on reasonable feedback. Additional revisions may be offered at our discretion but are not obligated.

8.5.2 Finalization After Second Revision

After the second Revision is completed, we will perform an internal quality and similarity check. If, in our reasonable judgment, the plush meets our quality standards and reflects the reference photos and instructions provided, we may finalize and dispatch the plush without requiring further customer approval.

A customer's dissatisfaction after the second Revision does not cancel the order. Cancellation rules still apply: full refund if canceled before shipment (Section 8.2.1), or the return process after delivery (Sections 8.1 and 8.3). This policy does not limit your return rights after delivery.

8.5.3 Sneak Peek Non-Refundability After Performance

The Sneak Peek fee may be non-refundable once Preview Photos have been sent. If you cancel your order before Shipped (Section 8.2.1), the Sneak Peek fee will be refunded in full regardless of whether Preview Photos were sent. If you return the plush after delivery under Section 8.1, the Sneak Peek fee is non-refundable once Preview Photos have been provided.

8.6 Delivery Issues, Lost Packages, and Damage Claims

If your package is marked as delivered but you cannot locate it, or if it arrives damaged, contact us at support@petslify.com so we can assist with the appropriate carrier process. We may request supporting information such as photos of the packaging/product, confirmation of the delivery address, or a carrier case number.

8.6.1 Notice Windows

To help us assist you effectively, please notify us within 7 days of the delivery date if an item arrives damaged or if tracking shows delivered but you cannot locate the package. For shipments stalled in transit, please contact us within 30 days from the shipment date shown on tracking. Timely notice allows us to open carrier investigations within applicable claim windows. Failure to notify us within these windows does not automatically waive your rights but may limit our ability to investigate and resolve the issue.

8.7 Warranty and Satisfaction Guarantee

Where we advertise a "lifetime warranty," it is limited to the following issues arising under normal intended use and proper care, subject to the conditions below and to the extent permitted by applicable law:

  • Color fading: The visible colors of the plush materially fade over time under normal indoor use and care.
  • Seam split: Seams split or stitching fails during normal intended use (for example, a seam opening under typical handling).
  • Damage during shipping: The plush arrives damaged due to shipping or handling in transit, provided you notify us within the notice window in Section 8.6.1 and provide the requested supporting information.

This warranty does not cover damage caused by misuse, accidents, washing, heat or moisture exposure, pet chewing or scratching, stains, odors, deliberate alterations, normal wear and tear outside the items listed above, or issues caused by third parties or carriers except as described under "Damage during shipping."

If you believe your plush qualifies under this warranty, contact us at support@petslify.com with photos and your order number. You do not need to return your plush before we respond — we assess all warranty claims from photos first. We will review your claim within 3–5 business days and will offer a comparable remedy (repair, replacement, or a comparable alternative) at no additional cost to you, at our discretion, and to the extent permitted by applicable law.

Where we advertise a "satisfaction guarantee" or "money-back guarantee," it is provided through the return process in Sections 8.1 and 8.3, which allows a return request within 30 days of delivery when return conditions are met. The satisfaction guarantee is subject to the return conditions in Section 8.1 and does not constitute an unconditional or unlimited guarantee.

9. User Content and Submissions

If you submit any content, such as comments, feedback, photographs, or other materials (collectively, "User Content"), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate, and otherwise use such content in any medium. We are and shall be under no obligation to maintain any User Content in confidence, to pay compensation for any User Content, or to respond to any User Content.

9.1 Rights to Use Customer Photos

By uploading or submitting photos of your pet, the plush products, or any other images through our customizer, by email, or via any other method, you grant us a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such photos in any media for marketing, promotional, and other commercial purposes, including but not limited to:

  • Our website, social media accounts, and online advertisements
  • Email marketing and promotional campaigns
  • Third-party advertising platforms (Google, Meta/Facebook, TikTok, etc.)
  • Press and media materials

Opt-out: If you do not want your photos used for marketing purposes, you may opt out at any time by emailing support@petslify.com with your name and order number. We will remove your photos from active marketing use upon delivery of your request. This opt-out does not affect photo use for order fulfillment, which is still required to complete your order, and cannot retroactively remove photos already published.

You represent and warrant that you have all necessary rights and permissions to grant us this license and that the use of your photos by us will not infringe upon or violate the rights of any third party.

This Section 9.1 governs all rights to customer photos and supersedes any narrower license language in Section 7.2 in the event of any conflict.

10. Intellectual Property Rights

All content on the Site, including text, graphics, logos, images, and software, is the property of Petslify or its content suppliers and protected by international copyright laws. The Petslify trademark is registered under Registration Number 97931939. Unauthorized use of any intellectual property may violate copyright, trademark, and other applicable laws.

11. Reviews and Endorsements

We value authentic customer feedback. The following policies govern reviews and endorsements related to Petslify products, consistent with the Federal Trade Commission's Endorsement Guides (16 C.F.R. Part 255, as updated in 2023) and the Consumer Review Fairness Act (15 U.S.C. §45b).

  • Genuine reviews only: We do not create, publish, or facilitate the creation of fake, fictitious, or misleading reviews. All reviews published on our Site or our review platform (currently Loox) reflect the genuine, unedited opinions of verified purchasers.
  • No suppression: We do not prevent or discourage customers from posting honest, negative reviews. We do not selectively publish only positive reviews or remove legitimate negative reviews.
  • Material connection disclosure: If we provide any incentive (discount, free product, payment) in exchange for a review or testimonial, we will ensure that the material connection is clearly disclosed alongside the review, consistent with FTC requirements. We will not solicit reviews in exchange for incentives without such disclosure.
  • SMS review requests: As part of our SMS marketing program (Section 27), we may send you a text message asking you to review your purchase. Responding to such a request and leaving a review is entirely voluntary. No incentive is offered in exchange for a review through our SMS program unless explicitly stated and disclosed.
  • Third-party review platform: Customer reviews on our Site are powered by Loox (loox.io). By submitting a review through Loox, you also agree to Loox's terms of service. We do not edit or alter review content before publication.
  • Your rights: Nothing in these Terms prevents you from posting honest reviews about Petslify on any independent platform (Google, Trustpilot, BBB, etc.) or from sharing your genuine experience.

12. Privacy Policy

Your submission of personal information through the Site is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection, use, and disclosure of your personal information, including your rights regarding photo use and SMS marketing data.

13. Cookies and Tracking Technologies

We use cookies and similar tracking technologies to enhance your experience on our Site. By using the Site, you consent to our use of cookies as described in our Privacy Policy. You may control cookie preferences through your browser settings or through any cookie consent tool displayed on the Site.

Our Site may contain links to third-party websites that are not affiliated with us. These links are provided for your convenience. We are not responsible for examining or evaluating the content or accuracy of any third-party sites and will not have any liability for any third-party materials or websites, including but not limited to the practices of payment processors, review platforms, or advertising networks.

15. Optional Tools

We may provide you with access to third-party tools over which we neither monitor nor have control. You acknowledge and agree that we provide access to such tools "as is" without any warranties or conditions. We shall have no liability arising from or relating to your use of optional third-party tools.

16. Errors, Inaccuracies, and Omissions

Occasionally there may be information on our Site that contains typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, offers, shipping charges, transit times, and availability. We reserve the right to correct any such errors and to change or update information or cancel orders if any information is inaccurate at any time without prior notice, provided that where an order has been placed in reliance on an incorrect price and the item has not yet Shipped, we will notify you and offer you the choice of proceeding at the correct price or canceling for a full refund.

17. Prohibited Uses

In addition to other prohibitions set forth in these Terms, you are prohibited from using the Site or its content:

  • For any unlawful purpose or to solicit others to participate in unlawful acts.
  • To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances.
  • To infringe upon or violate our intellectual property rights or those of others.
  • To harass, abuse, insult, harm, defame, slander, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.
  • To submit false or misleading information, including fake reviews or fabricated order disputes.
  • To upload or transmit viruses or any other malicious code that will or may be used in any way that will affect the functionality or operation of the Service.
  • To collect or track the personal information of others without their consent.
  • To spam, phish, or engage in any other form of unsolicited commercial communication.
  • To interfere with or circumvent the security features of the Service or related websites, systems, or networks.
  • To use the Site in any way that could damage, disable, overburden, or impair the Site.

We reserve the right to terminate your use of the Service or access to the Site for violating any of the prohibited uses.

18. Disclaimer of Warranties

We do not guarantee, represent, or warrant that your use of our Service will be uninterrupted, timely, secure, or error-free. The Service and all products delivered to you are provided "as is" and "as available" without any representation, warranties, or conditions of any kind, either express or implied, except as expressly provided in Section 8 (Returns and Refunds) and any written warranty we provide under Section 8.7, and subject to mandatory consumer rights that cannot be waived under applicable law.

We make no representations or warranties that our products will meet your specific expectations regarding visual accuracy or exact likeness. Because each plush is a handcrafted interpretation of your pet based on the photos you provide, minor variations are inherent to the nature of the product (see Section 7.3).

19. Limitation of Liability

In no case shall Petslify, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including lost profits, lost revenue, lost savings, or any similar damages, to the fullest extent permitted by law.

Without limiting the foregoing, we are not liable for:

  • Any damage arising from emotional distress, sentimental value, or the loss of use of a pet plush or related products, to the extent permitted by applicable law.
  • Any loss arising from the loss, corruption, or inadvertent disclosure of photos you submitted to us, provided we have taken reasonable steps to secure such photos.
  • Any loss caused by events outside our reasonable control (see Section 23.1).
  • Any loss attributable to a third-party carrier, shipping provider, or customs authority.

Nothing in this Section limits your rights under Section 8 (Returns and Refunds) or any mandatory consumer rights that cannot be waived under applicable law. In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability shall be limited to the maximum extent permitted by law.

20. Indemnification

You agree to indemnify, defend, and hold harmless Petslify and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand, including reasonable attorneys' fees, arising out of: (a) your breach of these Terms or the documents incorporated herein by reference; (b) your violation of any law or the rights of a third party; or (c) your submission of content (including photos) that infringes the rights of any third party.

21. Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions, which shall continue in full force and effect.

22. No Waiver

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. No waiver by us of any breach of these Terms shall be deemed a waiver of any subsequent breach of the same or any other provision. A waiver is only effective if made in writing and signed by an authorized representative of Petslify.

23. Termination

These Terms are effective unless and until terminated by either you or us. We may terminate this agreement at any time without notice if you fail to comply with any term or provision of these Terms, or if we choose to discontinue offering the Service. All obligations and liabilities incurred prior to the termination date shall survive the termination of this agreement for all purposes.

23.1 Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including but not limited to: carrier disruptions; customs or import delays; labor disputes or strikes; natural disasters; fire; flood; pandemic or public health emergency; supply chain disruptions; acts of government, war, or terrorism; power or internet outages; or any other cause beyond our reasonable control. In such events, we will endeavor to notify you promptly and resume performance as soon as reasonably practicable.

23.2 Assignment

We may assign or transfer these Terms, in whole or in part, to any affiliate, successor entity, or in connection with a merger, acquisition, or sale of assets, without restriction or notice to you, except where required by applicable law. You may not assign or transfer these Terms or any rights hereunder without our prior written consent. Any purported assignment in violation of this section is void.

24. Entire Agreement

These Terms and any policies or operating rules posted by us on the Site, including our Privacy Policy, constitute the entire agreement between you and us and govern your use of the Service, superseding any prior agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of these Terms). Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

25. Governing Law and Jurisdiction

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions, except where prohibited by applicable mandatory consumer protection law in your jurisdiction. Nothing in this Section prevents you from asserting mandatory consumer protection rights available under the laws of your country or state of residence.

26. Dispute Resolution

Informal Resolution First. If you have a dispute, please contact us first at support@petslify.com and allow 14 days for us to try to resolve it informally. Most concerns can be resolved this way.

Binding Arbitration. If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms, your purchase, or your use of the Site shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, except where prohibited by applicable law. Either party may bring qualifying claims in small claims court without first going through arbitration.

Class Action Waiver. YOU AND PETSLIFY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL ACTION OR PROCEEDING. Unless both you and Petslify agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding. If this class action waiver is found to be unenforceable with respect to a particular claim or request for relief, then only that particular claim or request for relief may proceed in court and must be severed from any arbitration.

Jury Trial Waiver. You and we waive any right to a trial by jury to the fullest extent permitted by law.

Arbitration Opt-Out. You may opt out of this arbitration agreement by sending written notice of your decision to opt out to support@petslify.com within 30 days of your first use of the Service or first purchase. Your notice must include your name, the email address used for your account or order, and a clear statement that you wish to opt out of arbitration. If you opt out, all other provisions of these Terms remain in effect.

Location. The arbitration may be conducted remotely (for example, by video conference) or in Cheyenne, Wyoming, unless the parties agree otherwise.

Governing Rules. The AAA Consumer Arbitration Rules are available at www.adr.org. In the event of any conflict between these Terms and the AAA Rules, the AAA Rules shall govern as to procedural matters.

By consenting to Petslify's SMS marketing at checkout or subscribing via our subscription tools, you agree to receive recurring automated text notifications at the phone number provided, including:

  • Order updates and shipping notifications
  • Abandoned cart reminders
  • Promotional marketing messages and special offers
  • Requests for reviews of your purchase

You may receive these messages even if your mobile number is registered on any state or federal do-not-call list.

Message Frequency and Opt-Out

Message frequency varies depending on your activity and our promotional calendar. Consent is not a condition of purchase. To unsubscribe at any time, reply STOP to any text message from us. You will receive one final confirmation message and then no further messages. You may re-subscribe at any time by opting in again at checkout or by texting START.

You understand and agree that alternative methods of opting out — such as using different words or requests — will not be considered a valid opt-out. Only the STOP keyword and the unsubscribe link provided in our messages constitute valid opt-out methods.

Charges and Fees

We do not charge for the SMS service. However, you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply.

Modification of Service

We reserve the right to modify any telephone number or short code we use to operate the SMS service at any time. You will be notified of such changes. You agree that messages sent to a changed number or short code, including STOP or HELP requests, may not be received, and we will not be liable for honoring requests made to changed numbers.

Limitation of Liability for SMS

To the extent permitted by applicable law, we will not be liable for failed, delayed, or misdirected delivery of any information sent through the SMS service, any errors in such information, or any action you may or may not take in reliance on the information or service.

No Third-Party Sharing of SMS Data

Your SMS opt-in data and consent will not be shared with any third party except our messaging platform partners, solely for the purpose of enabling and operating our text messaging program. It will not be sold or used for any other purpose.
